HakolyTerms of Service
These Terms govern your use of Hakoly (released in Japanese as さすだけフォト; the "App"), provided by NO PLAN inc. ("we", "us"). By installing or using the App you agree to these Terms.
1. License
We grant you a non-exclusive, non-transferable right to use the App in accordance with these Terms. A paid license is a one-time purchase covering the purchaser and their household, for the number of devices stated for the plan. Redistributing, publishing or selling license keys is prohibited.
2. Prohibited conduct
- Reverse engineering, decompiling or modifying the App, except as permitted by applicable law
- Circumventing license validation
- Uploading content you have no right to upload, or otherwise infringing the rights of others
- Any use that violates applicable law
3. Your data and your responsibility
You retain all rights to the photos processed by the App. We never receive them. The App can delete files from an SD card, but only after verifying that a checksum-matched copy exists on your Mac. Even so, data loss caused by media failure, storage failure or operating system defects cannot be entirely ruled out — keep independent backups of anything important.
4. Third-party services
The App uploads to Google Photos. Your use of Google Photos is governed by Google LLC's terms, and we are not responsible for its availability, behavior or changes.
5. Disclaimer of warranties
The App is provided "as is". We do not warrant that it will meet your particular requirements, that its automatic photo selection will match your expectations, or that it will operate without interruption. Automatic selection is a machine judgment and may exclude a photo you wanted or keep one you did not.
6. Limitation of liability
Our total liability is limited to the amount you paid us for the App. We are not liable for indirect damages, including lost profits or lost data, whether or not foreseeable. This limitation does not apply to our willful misconduct or gross negligence.
7. Refunds
Because the App can be evaluated for free before purchase, purchases are generally non-refundable. If a defect prevents the App from working, contact support@hakoly.com and we will address it individually.
8. Changes to these Terms
We may revise these Terms. Revised Terms take effect when posted on this page.
9. Governing law
These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction of the first instance over any dispute arising from the App.
